Personal data controller<\/p><p>Mikol\u00e1\u0161kov\u00e1&amp;Drobn\u00e1 represented by Tereza Drobn\u00e1, based in Filipova 2016\/6, 148 00, Praha 4, Czech Republic, CI No:&nbsp;07376944, enrolled in the trade register maintained by \u00da\u0159ad m\u011bstsk\u00e9 \u010d\u00e1sti Praha 11 (hereinafter referred to as the \u201ccontroller\u201d) hereby informs you, in accordance with Article No. 12 of the GDPR, about the processing of your personal data and your rights.<\/p><p>2. The scope of personal data processing<\/p><p>Personal data are processed to the extent in which the relevant data subject has provided them to the controller in connection with entering into a&nbsp;contractual or other legal relationship with the controller, or which the controller has collected otherwise and processes in accordance with applicable law, or to fulfil the controller&#8217;s obligations.<\/p><p>3. Sources of personal data<\/p><ul class=\"wp-block-list\"><li>Directly from the data subject<\/li>\n\n<li>Supplier<\/li>\n\n<li>Distributor<\/li>\n\n<li>Publicly accessible registers, lists and records (e.g. Commercial Register, Trade Register, Cadastre of Real Estate, public telephone directory, etc.)<\/li><\/ul><p>4. Categories of personal data that are subject of processing<\/p><ul class=\"wp-block-list\"><li>Address and identification data used for unambiguous and unmistakable identification of the data subject (e.g. name, surname, title, birth certificate number, date of birth, permanent address, identification number, VAT number) and data enabling contact with the data subject (contact details \u2013 e.g. contact address, phone number, email address, and other similar information)<\/li>\n\n<li>Descriptive data (e.g. bank account details)<\/li>\n\n<li>Other data necessary for the performance of the contract<\/li>\n\n<li>Data provided in excess of the relevant laws and processed within the consent of the data subject (processing of photographs).<\/li><\/ul><p>5. Purpose of personal data processing<\/p><ul class=\"wp-block-list\"><li>Purposes contained within the consent of the data subject<\/li>\n\n<li>Negotiating the contractual relationship<\/li>\n\n<li>Performance of the contract<\/li>\n\n<li>Protection of the rights of the controller, recipient or other persons concerned (e.g. recovery of the controller&#8217;s claims)<\/li>\n\n<li>Archiving maintained as per requirements of the Act<\/li>\n\n<li>Fulfilment of legal obligations of the controller<\/li>\n\n<li>Protection of the vital interests of the data subject<\/li><\/ul><p>8. Method of processing and protection of personal data&nbsp;<\/p><p>The processing of personal data is carried out by the controller. The processing is carried out in the premises and headquarters of the controller or by the processor. The processing is done with the use of computer technology, or for personal data in paper form, it is done manually, and in compliance with all security principles for the management and processing of personal data. For this purpose, the controller has adopted technical and organizational measures to ensure the protection of personal data, in particular measures to prevent unauthorized or accidental access to, alteration, destruction or loss of personal data, unauthorized transfers, unauthorized processing and other misuse of personal data. All subjects to whom personal data may be disclosed respect the right of data subjects to privacy and are required to comply with applicable data protection legislation.<\/p><p>9. Personal data processing period<\/p><p>In accordance with the deadlines specified in the relevant contracts, in the filing and shredding rules of the controller or in the relevant legislation, this is the period necessary to secure the rights and obligations arising from both the contractual relationship and the relevant legislation.<\/p><p>10. Instructions<\/p><p>The controller processes the data with the consent of the data subject, except in cases stipulated by law where the processing of personal data does not require the consent of the data subject. In accordance with Article 6 (1) of the GDPR, the controller may process the following data without the consent of the subject:<\/p><ul class=\"wp-block-list\"><li>The data subject has given his consent for one or more specific purposes.<\/li>\n\n<li>Processing is necessary for the performance of a&nbsp;contract to which the data subject is a&nbsp;contracting party or for the implementation of measures taken prior to the conclusion of the contract at the request of this data subject.<\/li>\n\n<li>Processing is necessary to fulfil the legal obligation applicable to the controller.<\/li>\n\n<li>Processing is necessary to protect the vital interests of the subject or another natural person.<\/li>\n\n<li>Processing is necessary for the fulfilment of a&nbsp;task carried out in the public interest or during the exercise of public authority entrusted to the controller.<\/li>\n\n<li>Processing is necessary for the purposes of the legitimate interests of the relevant controller or of a&nbsp;third party, except where the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data take precedence over those interests.<\/li><\/ul><p>11. Data subjects&#8217; rights&nbsp;<\/p><p>11.1.In accordance with Article 12 of the GDPR, the controller shall, at the request of the data subject, inform the data subject of the right of access to personal data and the following information:<\/p><ul class=\"wp-block-list\"><li>The purpose of processing.<\/li>\n\n<li>The category of personal data affected.<\/li>\n\n<li>Recipients or categories of recipients to whom personal data have been or will be disclosed.<\/li>\n\n<li>The planned period for which personal data will be stored.<\/li>\n\n<li>Any available information on the source of the personal data, if not obtained from the data subject, and whether automated decision making, including profiling, is taking place.<\/li><\/ul><p>11.2. Any data subject who discovers or assumes that the controller or processor is processing his personal data in a&nbsp;way that is contrary to the protection of the privacy and personal life of the data subject or to the law, in particular if the personal data are inaccurate for the purpose of their processing, can:<\/p><ul class=\"wp-block-list\"><li>Ask the controller for an explanation.<\/li>\n\n<li>Require the controller to remedy this situation. S&nbsp;takov\u00fdm zpracov\u00e1n\u00edm jste poskytl\/a sv\u016fj v\u00fdslovn\u00fd souhlas.&nbsp;<\/li><\/ol><p><strong>IV.<\/strong><\/p><p><strong>Doba uchov\u00e1v\u00e1n\u00ed \u00fadaj\u016f<\/strong><\/p><ol class=\"wp-block-list\"><li>Spr\u00e1vce uchov\u00e1v\u00e1 osobn\u00ed \u00fadaje&nbsp;<\/li><\/ol><ul class=\"wp-block-list\"><li>po dobu nezbytnou k v\u00fdkonu pr\u00e1v a povinnost\u00ed vypl\u00fdvaj\u00edc\u00edch ze smluvn\u00edho vztahu mezi V\u00e1mi a spr\u00e1vcem a uplat\u0148ov\u00e1n\u00ed n\u00e1rok\u016f z t\u011bchto smluvn\u00edch vztah\u016f (po dobu 15 let od ukon\u010den\u00ed smluvn\u00edho vztahu).&nbsp;<\/li>\n\n<li>po dobu, ne\u017e je odvol\u00e1n souhlas se zpracov\u00e1n\u00edm osobn\u00edch \u00fadaj\u016f pro \u00fa\u010dely marketingu, nejd\u00e9le 7 let, jsou-li osobn\u00ed \u00fadaje zpracov\u00e1v\u00e1ny na z\u00e1klad\u011b souhlasu.&nbsp;<\/li><\/ul><ol class=\"wp-block-list\" start=\"2\"><li>Po uplynut\u00ed doby uchov\u00e1v\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f spr\u00e1vce osobn\u00ed \u00fadaje vyma\u017ee.&nbsp;<\/li><\/ol><p><strong>V.<\/strong><\/p><p><strong>P\u0159\u00edjemci osobn\u00edch \u00fadaj\u016f (subdodavatel\u00e9 spr\u00e1vce)<\/strong><\/p><ol class=\"wp-block-list\"><li>P\u0159\u00edjemci osobn\u00edch \u00fadaj\u016f jsou osoby&nbsp;<\/li><\/ol><ul class=\"wp-block-list\"><li>pod\u00edlej\u00edc\u00ed se na dod\u00e1n\u00ed zbo\u017e\u00ed \/ slu\u017eeb \/ realizaci plateb na z\u00e1klad\u011b smlouvy,&nbsp;<\/li>\n\n<li>zaji\u0161\u0165uj\u00edc\u00ed slu\u017eby provozov\u00e1n\u00ed e-shopu a dal\u0161\u00ed slu\u017eby v&nbsp;souvislosti s&nbsp;provozov\u00e1n\u00edm e-shopu,<\/li>\n\n<li>zaji\u0161\u0165uj\u00edc\u00ed marketingov\u00e9 slu\u017eby.<\/li><\/ul><ol class=\"wp-block-list\" start=\"2\"><li>Spr\u00e1vce nem\u00e1 v \u00famyslu p\u0159edat osobn\u00ed \u00fadaje do t\u0159et\u00ed zem\u011b (do zem\u011b mimo EU) nebo mezin\u00e1rodn\u00ed organizaci. P\u0159\u00edjemci osobn\u00edch \u00fadaj\u016f ve t\u0159et\u00edch zem\u00edch jsou poskytovatel\u00e9 mailingov\u00fdch slu\u017eeb \/ cloudov\u00fdch slu\u017eeb.&nbsp;<\/li><\/ol><p><strong>VI.<\/strong><\/p><p><strong>Va\u0161e pr\u00e1va<\/strong><\/p><ol class=\"wp-block-list\"><li>Za podm\u00ednek stanoven\u00fdch v&nbsp;GDPR m\u00e1te&nbsp;<\/li><\/ol><ul class=\"wp-block-list\"><li>pr\u00e1vo na p\u0159\u00edstup ke sv\u00fdm osobn\u00edm \u00fadaj\u016fm dle \u010dl. 15 GDPR,&nbsp;<\/li>\n\n<li>pr\u00e1vo opravu osobn\u00edch \u00fadaj\u016f dle \u010dl. 16 GDPR, pop\u0159\u00edpad\u011b omezen\u00ed zpracov\u00e1n\u00ed dle \u010dl. 18 GDPR.&nbsp;<\/li>\n\n<li>pr\u00e1vo na v\u00fdmaz osobn\u00edch \u00fadaj\u016f dle \u010dl. 17 GDPR.&nbsp;<\/li>\n\n<li>pr\u00e1vo vzn\u00e9st n\u00e1mitku proti zpracov\u00e1n\u00ed dle \u010dl. 21 GDPR a&nbsp;<\/li>\n\n<li>pr\u00e1vo na p\u0159enositelnost \u00fadaj\u016f dle \u010dl. 20 GDPR.&nbsp;<\/li>\n\n<li>pr\u00e1vo odvolat souhlas se zpracov\u00e1n\u00edm p\u00edsemn\u011b nebo elektronicky na adresu nebo email spr\u00e1vce uveden\u00fd v&nbsp;\u010dl. III t\u011bchto podm\u00ednek.&nbsp;<\/li><\/ul><ol class=\"wp-block-list\" start=\"2\"><li>D\u00e1le m\u00e1te pr\u00e1vo podat st\u00ed\u017enost u \u00da\u0159adu pro ochranu osobn\u00edch \u00fadaj\u016f v p\u0159\u00edpad\u011b, \u017ee se domn\u00edv\u00e1te, \u017ee bylo poru\u0161eno Va\u0161\u00ed pr\u00e1vo na ochranu osobn\u00edch \u00fadaj\u016f.<\/li><\/ol><p><strong>VII.<\/strong><\/p><p><strong>Podm\u00ednky zabezpe\u010den\u00ed osobn\u00edch \u00fadaj\u016f<\/strong><\/p><ol class=\"wp-block-list\"><li>Spr\u00e1vce prohla\u0161uje, \u017ee p\u0159ijal ve\u0161ker\u00e1 vhodn\u00e1 technick\u00e1 a organiza\u010dn\u00ed opat\u0159en\u00ed k&nbsp;zabezpe\u010den\u00ed osobn\u00edch \u00fadaj\u016f.<\/li>\n\n<li>Spr\u00e1vce p\u0159ijal technick\u00e1 opat\u0159en\u00ed k&nbsp;zabezpe\u010den\u00ed datov\u00fdch \u00falo\u017ei\u0161\u0165 a \u00falo\u017ei\u0161\u0165 osobn\u00edch \u00fadaj\u016f v&nbsp;listinn\u00e9 podob\u011b, zejm\u00e9na pou\u017e\u00edv\u00e1n\u00ed&nbsp;odpov\u00eddaj\u00edc\u00edho se k&nbsp;ochran\u011b osobn\u00edch \u00fadaj\u016f, dodr\u017eov\u00e1n\u00ed pravidel bezpe\u010dn\u00e9ho u\u017e\u00edv\u00e1n\u00ed prost\u0159edk\u016f vzd\u00e1len\u00e9 komunikace, s&nbsp;d\u016frazem na ochranu osobn\u00edch \u00fadaj\u016f, fyzick\u00e9 zaji\u0161t\u011bn\u00ed ochrany prostor.<\/li>\n\n<li>Spr\u00e1vce prohla\u0161uje, \u017ee k&nbsp;osobn\u00edm \u00fadaj\u016fm maj\u00ed p\u0159\u00edstup pouze j\u00edm pov\u011b\u0159en\u00e9 osoby.<\/li><\/ol><p><strong>VIII. Cookies<\/strong><\/p><p><strong>Co je soubor cookie?<\/strong><\/p><p>Cookies jsou mal\u00e9 textov\u00e9 soubory, kter\u00e9 vznikaj\u00ed nav\u0161t\u00edven\u00edm ka\u017ed\u00e9 webov\u00e9 str\u00e1nky a kter\u00e9 se ukl\u00e1daj\u00ed do koncov\u00e9ho za\u0159\u00edzen\u00ed \u010di pam\u011bti koncov\u00fdch za\u0159\u00edzen\u00ed u\u017eivatel\u016f webov\u00fdch str\u00e1nek, v&nbsp;tomto p\u0159\u00edpad\u011b str\u00e1nek tohoto internetov\u00e9ho obchodu.
